An industry label does not decide overtime

The federal motor-carrier overtime exemption depends on the employer, safety-affecting duties and interstate transportation. A small-vehicle exception can change the analysis in particular workweeks. Other exemptions and state-law requirements may also matter.

Dispatch or office work is not automatically covered by the motor-carrier exemption merely because the company operates trucks. Explain what you actually do and which vehicles you work on or drive.

  • Gather dispatch messages, route sheets and vehicle information.
  • Compare driving, loading and other work with paid hours.
  • Keep pay agreements and records of deductions.

Distinguish discrimination from safety complaints

Unequal assignments after a discrimination complaint and discipline after reporting an unsafe vehicle may involve different protections. Safety-related whistleblower claims can have their own agency procedures and short deadlines. Record the content of your report, who received it and the employer’s stated reason for the later action.

Common questions

What employees ask us

Does driving only within Pennsylvania settle the exemption question?

No. A route entirely within one state can still connect to interstate transportation. Vehicle use, job duties and the movement of the goods require individual review.
